News Coverage Soundkeeper files suit against NYDEC

Journal News reports on Soundkeeper’s, et al Law suit filed November 30,  in New York Supreme Count at Westchester County for unlawful Industrial Storm Water Permits approved by the New York Department of Environmental Conservation (NYDEC). This permit allows for what amounts to self regulation and provides no opportunity for public notification or hearing.  Click headline for more and link to Journal News story

This MSGP for industrial storm water  permit contains many of the same problems and illegal elements as did the MS 4 general permit for municipal storm water. Soundkeeper challenged the MS4 permit in  Court.  Soundkeeper won this case but DEC appealed the decision. The MS 4 appeal has been briefed and we await a court date for oral arguments.
